Social Committee Report: Luau dinner on September 26th was a big success. 40 people with four dinners to-go. As a surprise all dinners were fully refunded. October 24th is the next event. Fiesta dinner. Tacos, rice and beans, salad, salsa and chips. Beer, wine and soda included. Residents $12, Guests $15. Cutoff date to have your money in is October 17th.

GSMOL Report: No meeting this month

New Business: A resident inquired if the benches around the park could be replaced. The only decent one is the one Ed Aasted takes care of. In addition, Ed Aasted donated a new sound system/microphone to the Social Committee. (Thank you Ed for all you and Linda do for the Park)

Gopher problems continue… install owl boxes?

Mail Boxes need painting. Is the water project done? Can the street be reopened? Pool area? Cement was recently poured but residents are feeling things are way behind with many Board members being approached with the dissatisfaction felt by many residents. Lack of onsite manager brought up. Residents are very upset with the answer that mostly county’s fault. Lack on entry to the Clubhouse is particularly hard on residents with walkers or heavy loads. Question is can the front at least be done quickly so all can gain easy access to the Clubhouse again. An added plus would be Cristina could get out of the cave and terrible working conditions downstairs.

Problems not addressed in a timely manner: Where are the new street signs? Were supposed to be done by now. The Board noted the new No Parking signs which warn that your vehicle could be towed. Question was when? It is thought that 3 warnings (all kept track of at the Office with pictures taken by Security which automatically has a date stamp on it) After 3 notices your vehicle WILL be towed. Continuing and ongoing problems with the Clubhouse not being unlocked during stated hours 7 days a week from 7:00 am to 9:00 pm! One resident called the “Emergency number” twice and no one picked up (??) and then Frank was called twice and no one picked up so resident crawled through a window to gain access a little after 8:00 am on a Saturday. There is no way a resident with a problem and doesn’t want a Work Order can address it. Again, no onsite manager. Back entrance on Cathedral Oaks is looking very shabby. Just a slow walk down the street would show lots of dead, dying bushes, lots of weeds and sprinkler that apparently doesn’t work very well. Where is the new map at the front and the back one refinished? Is the bright blue house color truly approved? The committee thought that it was in the rules that it should be in earth tone shades? What happened to the white rockers on the upper deck? Can someone pay better attention to Flag protocol as to when the flag should fly at half-mast at the correct times? It is lowered many times days late and many times left down for too many days. Disrespectful.

On the plus side the TV in the dining room was replaced very quickly after the Office was told about it. Great response.

GSMOL Report by Ellen Duke:

The 2019-2020 Legislative Session has ended with GSMOL victories:

AB 2782 (including provisions of SB 999) – Establishes minimum state standards for park conversions and closures and eliminates loophole that denies mobilehome residents with long term leases the protection of rent control.

AB 3088 (includes some protections of SB 915) – Protects tenants, including mobilehome residents, from eviction and property owners from foreclosure due to economic impacts of COVID-19. (SB 915 would have also required deferred rent payments for mobilehome residents affected by Covid-19 but legislature ran out of time before vote.)

GSMOL-Opposed AB 2895: Proposed to extend the same percentages and numbers in rental base adjustments as applied to apartment renters, which would have increased rents for mobilehomes. Bill was withdrawn before vote.

There were two GSMOL-Sponsored Townhalls this week:

1) Thursday, September 10th at 1 PM – HCD* State Audit Report Virtual Townhall:  Streamed live from State Senator Leyva’s office with State Auditor Elaine Howel. The audit was the result of GSMOL’s advocacy efforts and revealed significant issues that are being addressed. (*California Dept of Housing and Community Development – which inspects mobilehome parks.)

2) Friday, September 11th at 1:30 PM: Telephone Townhall with GSMOL Attorney Bruce Stanton:  GSMOL’s attorney will explain what the passage of AB 2782 and AB 3088 means for manufactured-home owners.

DPG Report: Meeting will be Sept. 16 at 7:00 in the Clubhouse. Please bring your radio.

New Business: These items were discussed via Teleconference this afternoon. In attendance were, Bob Mann, Cheryl Mracheck, Mary Manzo and Antonio Frausto.

Roads: Slurry seal gooks great, with few exceptions. Antonio and Frank will inspect and address the problem areas.

Water Project: Is complete except for the final connection of the emergency standby generator and fencing.

Pool Project: More delays with County Environmental Heath involved with the permitting and inspections. Plumbing problems have been completed. Now in the process of grading, compaction and installing the drains. Pavers will be installed and interior of the pool will take place soon. Late October is now the time for completion.

RV Parking area: This project is on hold until the final completion of Water and Pool project.

Street signs: Signs and numbers are being redone and should be completed by the end of September. The street known as Indian Wells will become a continuation of Stagecoach. Hang Tree will become Olive Branch.

Signs painted on roadways that read 10 MPH. Why these are not painted in other areas and the possibly of painting them a different color that would be more visible.

San Vicente has hired an Assistant Manager. Until training is complete the office hours will be 1:00-5:00 Monday-Friday. The phone message will be changed to reflect the new hours.

Sign on San Vicente property between San Vicente and RSB: Please do not use the arroyo to travel from our park to Rancho Santa Barbara. This is private property and a liability issue.

There was a discussion on what to do with the unused property next to the Water plant. Possible uses could include a new home site for an onsite manager.

Questions from residents:

A resident has notified the board about some political signs being removed from their property.

 

Despite how divided this country has become, the opinions of all should be respected. The theft of personal property is a misdemeanor and will be subject to arrest and prosecution. In addition, verbal harassment of residents (haranguing, cussing and photographing of residents of different opinions then theirs) needs to stop.

A resident asked, why we are being charged for the pass-thru on the RV area when it is unknown and not on the calendar to be completed.

Social Committee Report: The Champagne Brunch was a success with 34 persons in attendance. Next event is a Luau on July 25th. The menu will be Kalua ham, fried rice, tropical fruit salad, Hawaiian sweet rolls and Pineapple upside down cake. Cost is $12 for residents and $15 for guests. Cutoff date to sign up is July 18th.

GSMOL Report by Ellen Duke:

Bills supported by GSMOL are moving successfully through the California Legislature. Park owners are pushing against them so it is important that we show our support.

Letters are awaiting your signature at Ellen Duke’s’ front deck at Space #194 (Indian Wells Road). The signed letters can be placed in the marked box. Ellen will scan and email the letters to our lobbyist. Here are the four bills:

SB 915 (Leyva) prevents evictions and requires deferred rent payments for mobilehome residents impacted by COVID-19. 

SB 999 (Umberg) eliminates the loophole that denies mobilehome residents with long-term leases local rent stabilization protection.

AB 2690 (Low) eliminates the loophole denying local rent stabilization protections if a park or space was created after the year 1990.

AB 2782 (Stone) establishes state standards for park conversion, including requiring a relocation plan, report on impact on low-income housing stock and, if no space is available in another park, ensuring impacted residents receive in-place market value of their mobilehome. (Note: Santa Barbara County already has a comprehensive ordinance and would not be affected by this bill.)

Mobilehome owners are an important voting block and your help is needed to make sure these needed changes happen. Please call Ellen at 805-637-3327 for information or if you need to have these letters brought or emailed to you for signature.

President’s statement:

New Business: The last few months have been difficult for all, but life must go on. SVMHA understands that extra caution must be taken for our protection. The Board will continue to take care of business and members will be updated via email.

It appears that someone in the park has complained to management about two street names that appear to be offensive. Hang Tree and Indian Wells are in the process of being changed.

Someone who has access to the gym has stolen two #20 dumbbells. After all the effort from management to make a commitment to purchasing and maintaining this equipment, this is the thanks they get. Please if you know who has stolen this equipment, please notify management or the HOA. Thank you.

Roads to be slurry coated in August. If any resident notices problems in the road surface, please notify management or the HOA so these issues can be fixed before the slurry seal is applied.

Water Project is completed, except for the installation of the Emergency stand by generator.

Pool Project is moving rapidly now. Upon the deck removal, county inspectors noticed that the plumbing was not buried deep enough. The project has been delayed because everything had to be brought up to 2020 standards. Now a projected August completion is expected.

RV Parking area Management is looking for a different contractor to do this project. Late summer estimated completion.

Questions from residents:

Trees on Cathedral Oaks need trimming, Lilith will notify Cristina.

The walk way between our park and Rancho was blocked. Why? Many residents use this path to walk between parks for exercise. RSB does not appear to have a problem with this. Could San Vicente and RSB jointly create a permanent pathway between the parks? The board was instructed to send a letter to management with our concerns.

A question was asked about the size of the pavers that will be used around the pool area. Will there be a gap between the pavers for drainage and would such a gap become a hazard for a cane or walker with narrow wheels?

Social Committee Report: Charlene Hovey: The End of Summer event is Sept. 22nd. Hamburgers and Hot Dogs, beans, Drinks and Ice Cream. $7 for residents and $10 for guests. Make sure you get your checks in ASAP. This event will fill up fast and could be closed before the actual cut-off date.

Document Review Committee/GSMOL Report:

Ellen thanked the Document Review Committee for their work.  Committee members included:  Tony Armendariz, Patty Byrum, Rama Fox, Tony Jimenez, Dick Mires and Ellen Duke.  GSMOL provided access to the experience attorney and our HOA provided the funds.  Ellen repeated that the new park documents were significantly better than those received last year.  St. Vincent’s modified the majority of approximately 30 concerns.  Continuing concerns include 1) the definition of common area facilities not including the Gym or RV Park, 2) the subletting prohibition, 3) burdensome requirements for prior written approval, 4) a manager who has to refer many managerial decisions to others, 5) the park indicating that it does not consider itself responsible for providing a resident directory, and 6) liability language in the Rental Agreement (our attorney, Bruce Stanton, advises us that this language will not take effect if the Homeowner does not sign the Rental Agreement).

It is important that everyone read the documents when they are distributed.  The Committee may have missed something.

GSMOL Attorney Bruce Stanton advises existing residents of California mobile home parks that they are not required to sign new park documents and should not sign new documents unless it is beneficial to them.  In our case, he is advising us not to sign the documents.  However, we can sign or initial that we have received the documents.  Ellen is checking on whether new residents who had to sign the 2017 Rental Agreement in order to move into the park may be advised differently.

Volunteers are needed to help distribute a flyer door-to-door to all homeowners which will include our attorney’s recommendations.  Please email Ellen Duke (ebduke@yahoo.com) or message or call Ellen at 805-637-3327 if you can help. This is an important service to our whole community.

Rama Fox, Space #34, is chairing the Subletting Committee, which is preparing for a presentation to Management.  The option of subletting can make a big difference in a person’s life – and their family’s.  Please send letters regarding the importance of subletting and how its prohibition will affect you to Rama Fox as soon as possible:

DPG Report: Bob Enderby is working on ideas to help residents evacuate in case of emergency. Suggest using Cathedral Oaks gate to avoid congestion on Old Mill with Rancho and Apartment residents. The other gate at the end of Round Tree would also be open and an option, with limited clearance of 11’ and no pavement. An evacuation map will be included in next month’s Voice.

Business: Our new park directory has some issues. The time has passed for residents to submit corrections. Hopefully the 2019 directory will cross reference by name and space number, which seems to be where all the errors are.

The HOA sent an email to Mary Manzo on August 1st regarding the Arroyo, security of the “man” gates and the lack of fencing behind the RV storage area. A response was returned the next day. The bid for the work in the arroyo will most likely take place in September. Management is submitting a work order for the “man” gates. They are also requesting bids for higher fencing behind the RV area.

HOA membership is down from last year. We need to seek out and talk to neighbors who may have forgotten to pay their dues in 2018.

Inspections: Management has streamlined the inspection report to make it easier for the residents to understand. Many sheds are “grandfathered “in for now, but when property is sold management could make the owner fix any discrepancies before sale is complete.

Onsite manager issue. Does San Vicente have to provide an on-site manager? St. Vincent’s response was that their manager could respond, if needed. Our manager and Director of maintenance both live in the Ventura area and was impossible for both to respond during the Montecito US 101 closure in January.

We would like to have an update on the status of the gym equipment. Many residents are eagerly awaiting the news.

Social Committee Report: Mollie Mann: The Sept. 21st BBQ is closed. There is a waiting list. Tri Tip by Stanley. August, no event. September is a mystery dinner by Stanley.

2018 Document Review Committee Update by Ellen Duke:

On June 29th, the committee submitted their recommendations and concerns to St. Vincent’s. There were about 30 items.

On July 16th, St. Vincent’s will meet with the committee to respond to the report.

St. Vincent’s has indicated that they will be issuing a new document package in early August.  St. Vincent’s will be holding a “Meet and Confer” meeting with residents after the new documents are issued, as they did last year.

A response is being prepared to St. Vincent’s announcement that they will not permit subletting even though it does not affect their nonprofit status. This contradicts what was promised at last year’s Meet and Confer meeting and will negatively impact residents. Residents are encouraged to contact Rama Fox or Ellen Duke regarding the importance of this issue or to share experience with subletting.

The GSMOL attorney continues to advise all residents that they are not required to sign any of the new documents and the attorney advises us not to sign any of the new documents. He reports that the last rental agreement that we signed is the one that is in effect, unless we sign a new rental agreement. New residents will have to sign the new rental agreement to move into the park. The new rules and regulations, architectural standards will go into effect from 2 months to 6 months after issued unless they are withdrawn.

GSMOL Update by Ellen Duke:

Thursday, July 26th is the next GSMOL meeting. Everyone is encouraged to attend. This will be after St. Vincent’s response to the committee’s report. There will be a discussion of the anticipated documents and options for response.

Information was received that indicated that not everything on the inspection sheets being distributed had to be done immediately. This is being researched further.

Ellen noted the importance of everyone joining HOA and GSMOL, or at least one of those organizations.

Water Aerobics

There was a spirited discussion about the conflict between the Thursday 10:30 – 11:30 Water Aerobics class and the posted Guest Hours of 10am – noon daily. After the meeting, Ellen Duke followed up with management (Isabel) and was told that in the future, swimmers will be allowed to swim in the pool while the class is going on. Ellen confirmed this with water aerobics class participants.

Business: Our new park directory has some issues. Management said they noticed four errors. But a resident did a survey and has discovered more than 21 errors. The information that was gathered by residents going door to door was not utilized. Preferences of residents about phone numbers, names, etc. needs to be fixed.

To add to the problems that are occurring at the pool. During guest hours, some residents who are swimming laps are instructing the guests to stay out of the lap area. Guests that happen to be small children need to swim side to side and must cross the lap lane. Solution: Residents should swim when guests are not allowed.

Residents would like to have the GYM equipment back sooner than later. Also wondering why tennis courts are getting an update first. One resident has asked management four to five times about the equipment and has not received an answer. We would like a time line, not the standard answer, “we are looking into it”. Opinion is that, why the gym equipment was completely removed, where no one could use equipment, but money was invested in the tennis facility which was in need of repair, but still useable.

One trade off we used to enjoy, was the reciprocal agreement with Rancho, where we could use the golf course and they could use our tennis facility. Is this agreement still in effect?

The “peeping-tom” issue was handled poorly. The incident was reported to the office on June 5th and the only notification to residents appeared in the “Park Update” dated June 27th. Unacceptable.

Fencing between the apartments on Old Mill and the RV parking area is only two feet high. No security as anyone could enter our park anytime.

Rancho Santa Barbara is in the process of trenching and deepening the channel of Atascadero creek. With the forecasters now predicting an El Nino this winter, the question we have: is San Vicente going to deepen the channel thru our park this summer and fall before the rains come.

A resident voiced concerns about not having maps readily available for anyone, guests or vendors coming to our park for business. If there is no map, how can individuals know which way to proceed? Another suggestion was to replace the small signs throughout our park are faded and hard to read that point to which space numbers are where. Suggestion: Put the big map back up at the Old Mill entrance?

Property inspections: Forms are confusing. No prioritization on what needs to be done immediately or can wait. Many do not understand the last page.

Concerns about how slowly things are being done. Simple questions still take weeks to answer. Frustration

Charlene Hovey has contacted Shred-to-You to come to the park on August 8th at 11:00 for any document shredding that you wish to do. A typical “bankers box” around 25 pounds will cost $5.00. To be paid by the individual with their documents. Details will be in the Voice next month.

The email list of HOA members is being updated. Those who have not paid their dues for 2018 will be removed from the list.

GSMOL: Monthly meeting on June 28 at 6:00.

Report from the document review committee by Ellen Duke:

1) The committee was provided the documents by St. Vincent’s and is actively working on the document review.

2) The format and readability of the documents is dramatically better than last year. 

3) The documents have been sent to the GSMOL Attorney for review, along with our questions.  

4) We don’t want to talk about specifics because the documents may change based on our review and comments.  There is no reason for more homeowners to be concerned yet about what may not even be included in the document or about what we may better understand before the documents are issued.  All homeowners will have time to review all the documents when they are issued. 

5) The committee agreed that the one exception to this, due to the significant impact it will have on some people, is to share that the new documents do not allow subletting other than the limited subletting for health reasons required to be permitted by the MRL.  (We understand that this is what has been told to new residents this year, anyway.) Sub lessees and sub lettors are given until August 2019 to comply.  

DPG Report: Bob Enderby has been meeting with block captains and updating paperwork.

Business: Discussion to return the DPG funds that were co-mingled with the HOA in September 2016. Motion was made by Bob and seconded by Cindy and approved by the board.

New Business:

A letter was read that was sent to management on June 5th with concerns about the pool/Jacuzzi area and its appearance. There was also an inquiry of purchasing new exercise equipment?

Questions put forth from homeowners to HOA:

Some residents have complained that their rent checks are being held up to ten days before being deposited.

A resident has had a “peeping-tom” in the middle of the night. She was awakened at around two in the morning with a big flashlight shining in her bedroom window. The question is, why were there no notices placed in the tubes alerting the residents. After hearing about this event, it was pointed out that the park is not secure. A resident pointed out that the area behind the RV parking area, the fence is only about two feet tall. (Too easy to access from the apartment parking lot).

The pedestrian gates do not close every time. Possible to install new springs, where gates close and lock every time?

The new resident directory has errors that were pointed out. (Please check your personal info).

There was a question about speeding thru our park. Should the HOA send letters to the offending companies again or should the letters come from management. If the letter is received from St Vincent’s maybe the offenders will pay attention.

Outside wall on Cathedral Oaks needs some attention. Some bags are tucked behind the bushes which appears to be belongings of homeless people.

Could the residents receive the official SCE notice when a planned outage is scheduled? It was said some pertinent info was left off of San Vicente memo.

A big thank you to management for the New TV in the clubhouse.

Water pressure does not appear to be an issue during power outages. The emergency generator seems to be working fine.

Security has been seen in the park. Thank you for the extra patrols.

Meeting called to order at 7:00

Officers Present: Bob Mann, Mark Allen

The minutes from the March 8th meeting: motion to approve was made by Dick Mires and 2nd by Mark Allen

Guests: 18 guests were in attendance.

Expenses for March: Bank charge of $2.50 and Check to Brown and Brown insurance for $1700.00

 

Social Committee Report: Mollie Mann: next event will be Champagne Brunch, April 21st 5 spots are still open. This will be catered by Stanley and Martha of course. Cost is $10.00 per resident and $12 for guests. Details will be in the Voice.

Ellen reported that St. Vincent’s management is not ready with the new rules package documents. Also sent pictures of Park to management for repair work. She requested an open ended up to $2000.00 for Bruce Stanton, attorney, for review of the documents after SVHOA and GSMOL committees have reviewed them. Motion was 2nd by Cindy and it passed. Ellen also informed the meeting that after the documents are received, Rosa will then call a meeting of the Park residents regarding the water issue.

DPG Report: Bob Enderby is holding a Fund raiser for DPG with a pancake breakfast on Saturday, April 14th from 10-1:00 pm. Cost is $7.00 and there are 65 people signed up. There will be a discussion on Earthquake safety. Next meeting will be June.

Business: Motion was made by Bob Mann to include the Art Committee on the alcohol insurance policy and 2nd by Don Webb, passed.

New Business: The HOA will reimburse John Wiley $18.00 for SVMHP website domain name. This is annual, motion made by Dick Mires second by Lilith, passed. Spring cleaning dumpsters are here. No contractor’s waste to be permitted as last year someone filled one of the dumpsters costing Mgmt. unnecessary expense. Please call office immediately if this is observed.

Questions put forth from homeowners to HOA:

Management Inspection of Units and Sites: Notice put in our tubes states that they will do 30 units a month so doing the math that will be

9 months, an extraordinary amount of time. Previous mgmt. did this task in 5-7 days, why is the process going to take so long? Since there are many unacceptable, not up to standard units now that should be written up in a timely manner will they be continued to be allowed if it is not their particular month to be inspected? (it is evident from a walk around the Park that many are sliding thru the cracks as shabby outward appearance continues month after month) HCD has a check list of what needs to be inspected and in good order, i.e.: handrails, stairs etc.

A good suggestion was made by a resident, since our crew every month has to read the meters and as such can clearly see poor upkeep could they make a note of the space number and give to mgmt. to look into further? Another resident noted that last year some residents were notified to get their sagging siding fixed and others that were unable or unwilling to clean up the weeds had our crew do it for them and then were billed for it.

The Redo of the cracks around the Pool: Appears only one side of the pool was done.

Dead/Dying Bushes: There are dead and dying rose bushes under the San Vicente signage at the back gate. Might they be replaced with living rose bushes?
