GSMOL Report by Ellen Duke:

Bills supported by GSMOL are moving successfully through the California Legislature. Park owners are pushing against them so it is important that we show our support.

Letters are awaiting your signature at Ellen Duke’s’ front deck at Space #194 (Indian Wells Road). The signed letters can be placed in the marked box. Ellen will scan and email the letters to our lobbyist. Here are the four bills:

SB 915 (Leyva) prevents evictions and requires deferred rent payments for mobilehome residents impacted by COVID-19.

SB 999 (Umberg) eliminates the loophole that denies mobilehome residents with long-term leases local rent stabilization protection.

AB 2690 (Low) eliminates the loophole denying local rent stabilization protections if a park or space was created after the year 1990.

AB 2782 (Stone) establishes state standards for park conversion, including requiring a relocation plan, report on impact on low-income housing stock and, if no space is available in another park, ensuring impacted residents receive in-place market value of their mobilehome. (Note: Santa Barbara County already has a comprehensive ordinance and would not be affected by this bill.)

Mobilehome owners are an important voting block and your help is needed to make sure these needed changes happen. Please call Ellen at 805-637-3327 for information or if you need to have these letters brought or emailed to you for signature.

DPG Report: No report

President’s statement:

New Business: The last few months have been difficult for all, but life must go on. SVMHA understands that extra caution must be taken for our protection. The Board will continue to take care of business and members will be updated via email.

It appears that someone in the park has complained to management about two street names that appear to be offensive. Hang Tree and Indian Wells are in the process of being changed.

Someone who has access to the gym has stolen two #20 dumbbells. After all the effort from management to make a commitment to purchasing and maintaining this equipment, this is the thanks they get. Please if you know who has stolen this equipment, please notify management or the HOA. Thank you.

Roads to be slurry coated in August. If any resident notices problems in the road surface, please notify management or the HOA so these issues can be fixed before the slurry seal is applied.

Water Project is completed, except for the installation of the Emergency stand by generator.

Pool Project is moving rapidly now. Upon the deck removal, county inspectors noticed that the plumbing was not buried deep enough. The project has been delayed because everything had to be brought up to 2020 standards. Now a projected August completion is expected.

RV Parking area Management is looking for a different contractor to do this project. Late summer estimated completion.

Questions from residents:

Trees on Cathedral Oaks need trimming, Lilith will notify Cristina.

The walk way between our park and Rancho was blocked. Why? Many residents use this path to walk between parks for exercise. RSB does not appear to have a problem with this. Could San Vicente and RSB jointly create a permanent pathway between the parks? The board was instructed to send a letter to management with our concerns.

A question was asked about the size of the pavers that will be used around the pool area. Will there be a gap between the pavers for drainage and would such a gap become a hazard for a cane or walker with narrow wheels?

Speeding still a problem……………..SLOW DOWN

The next HOA meeting will be on August 13, 2020 at 7:00 pm

Document Review Committee/GSMOL Report:

Ellen thanked the Document Review Committee for their work.  Committee members included:  Tony Armendariz, Patty Byrum, Rama Fox, Tony Jimenez, Dick Mires and Ellen Duke.  GSMOL provided access to the experience attorney and our HOA provided the funds.  Ellen repeated that the new park documents were significantly better than those received last year.  St. Vincent’s modified the majority of approximately 30 concerns.  Continuing concerns include 1) the definition of common area facilities not including the Gym or RV Park, 2) the subletting prohibition, 3) burdensome requirements for prior written approval, 4) a manager who has to refer many managerial decisions to others, 5) the park indicating that it does not consider itself responsible for providing a resident directory, and 6) liability language in the Rental Agreement (our attorney, Bruce Stanton, advises us that this language will not take effect if the Homeowner does not sign the Rental Agreement).

It is important that everyone read the documents when they are distributed.  The Committee may have missed something.

GSMOL Attorney Bruce Stanton advises existing residents of California mobile home parks that they are not required to sign new park documents and should not sign new documents unless it is beneficial to them.  In our case, he is advising us not to sign the documents.  However, we can sign or initial that we have received the documents.  Ellen is checking on whether new residents who had to sign the 2017 Rental Agreement in order to move into the park may be advised differently.

Volunteers are needed to help distribute a flyer door-to-door to all homeowners which will include our attorney’s recommendations.  Please email Ellen Duke (ebduke@yahoo.com) or message or call Ellen at 805-637-3327 if you can help. This is an important service to our whole community.

Rama Fox, Space #34, is chairing the Subletting Committee, which is preparing for a presentation to Management.  The option of subletting can make a big difference in a person’s life – and their family’s.  Please send letters regarding the importance of subletting and how its prohibition will affect you to Rama Fox as soon as possible:

Rama Fox, Space #26, or by email: rama@ramafox.com

Please join HOA and GSMOL!   The next GSMOL Meeting is Thursday, August 23rd, at 6 PM.

DPG Report: Bob Enderby is working on ideas to help residents evacuate in case of emergency. Suggest using Cathedral Oaks gate to avoid congestion on Old Mill with Rancho and Apartment residents. The other gate at the end of Round Tree would also be open and an option, with limited clearance of 11’ and no pavement. An evacuation map will be included in next month’s Voice.

Business: Our new park directory has some issues. The time has passed for residents to submit corrections. Hopefully the 2019 directory will cross reference by name and space number, which seems to be where all the errors are.

The HOA sent an email to Mary Manzo on August 1st regarding the Arroyo, security of the “man” gates and the lack of fencing behind the RV storage area. A response was returned the next day. The bid for the work in the arroyo will most likely take place in September. Management is submitting a work order for the “man” gates. They are also requesting bids for higher fencing behind the RV area.

HOA membership is down from last year. We need to seek out and talk to neighbors who may have forgotten to pay their dues in 2018.

Inspections: Management has streamlined the inspection report to make it easier for the residents to understand. Many sheds are “grandfathered “in for now, but when property is sold management could make the owner fix any discrepancies before sale is complete.

Onsite manager issue. Does San Vicente have to provide an on-site manager? St. Vincent’s response was that their manager could respond, if needed. Our manager and Director of maintenance both live in the Ventura area and was impossible for both to respond during the Montecito US 101 closure in January.

We would like to have an update on the status of the gym equipment. Many residents are eagerly awaiting the news.

Speeding still a problem……………..SLOW DOWN

GSMOL Report from Ellen Duke:

Homeowners Association

GSMOL Chapter 1316 Report

San Vicente Mobile Home Park

The following update was provided by Rosa Paredes, President and Chief Executive Officer of St. Vincents/Vincent Ministries:

1.      In regards to whether or not San Vicente Mobile Home Park will allow subleasing, we are not ready to discuss this topic at this time since we are still discussing and reviewing it internally with our advisors and attorneys.

2.       We are also continuing to update the Rental Agreement and Rules & Regulations.  We are anticipating that the draft will be available for the sub-committee’s review early next year.  As you know, we do not want to rush this process and are diligently reviewing these documents to ensure they are in compliance with the law.

3.       The updated Rental Agreement and Rules and Regulations will be distributed as they were last time in accordance with the Mobilehome Residency Law and a Meet and Confer will be scheduled after the sub-committee reviews the documents.

4.       Assuming the meet and confer is scheduled in February/March 2018, means the new documents will be in effect approximately in August/September 2018 of next year.

5.     Also, please remind the Residents that they can email or contact the onsite manager directly for any concerns or comments.  She will communicate items as appropriate to Mary Manzo or myself.

6.     We have interviews scheduled for the office clerk this week.  Hoping to fill the position ASAP.

Note from Ellen Duke, GSMOL Chapter President, HOA Board Member: Due to last-minute scheduling problems, Rosa was not able to meet with me. We will reschedule before the next meeting. Meanwhile, you can send any questions or concerns about this update or issues not addressed by management to me at ebduke@yahoo.com.

It is great to see the improved maintenance on the clubhouse and repair of the pool deck. At the meeting, concerns were expressed about over-chlorination of the jacuzzi due to the need for a new part, and the effect of the reduction in maintenance staff and increased time needed for them to complete new paperwork. There were complaints about how the grounds are being maintained and the cut back in refuse service. Homeowners were advised to submit their specific concerns to management, and they can copy Ellen and/or advise her if concerned about the response.

Business: With the absence of the Disaster Preparedness Group, should the HOA try to continue this program? We have merged the funds from the DPG with the HOA. Steve Roth was in attendance and was thanked for his years of service to the DPG. Anyone that is interested please contact an HOA board member.

Resident’s Suggestions: Questions on what is taking so long to fix the pool deck. We passed on that management is also doing some work in the shower area, which might add some time to the finished product.

Residents voiced concerns that maintenance issues are being overlooked. Trees needing to be trimmed, bushes hiding stop signs, etc… General consensus is the maintenance crew is understaffed.

The Jacuzzi needs some repair. The chlorine level is so high that it hurts your eyes when you are in the water.

Garbage pickup question. Only 1 or 2 bags of clippings. 2 different residents were informed only 1 bag a week of yard clippings would be picked up?? Needs to be reviewed by St. Vincent’s.

Security cameras were brought up again. Will pass on to the management.

Board Elections: 6 positions need to be filled. Max will not be running and with the death of Paul we will need 2 new people to fill their positions. Please contact Board if interested in joining. Bob, Cheryl, Don and Ellen are again running for the board. Last day to sign up is November 10th.

Old Business: Gym equipment from Clubhouse is stored at St. Vincent’s. If you want your old equipment you can pick it up. Hopefully new equipment will be coming.

Speeding still a problem please ask all to slow down. Continuing complaints.

(Congratulations and thanks to ELLEN!)  They have formed a Communication Committee who has distributed the information to all of the Park residents not to vote on the new Lease Agreement until the Board has had time to consult Legal Counsel.  Also, please write to our local Congressmen to vote “YES of AB-69”. The GSMOL San Vicente Chapter will meet next on 6/29/17 at 6:00 at the Clubhouse.

Announcements – Bob Mann

Rosa Paredes of St Vincent’s stated she appreciated the letters that have been sent by residents.  She further reported that J&H will not take over the new management until July 29.  Stuart and Miguel will remain until that time.  The new office hours are 8-noon Monday – Thursday.

Business:
New
– Ronnie Sumter has resigned from the Board and the Board in closed session appointed Max Lynn to fill the remainder of the term, which expires in December 2017.

The board voted to appoint Paul Ortega as the association Vice-President.

New –The Board has voted and approved an additional new policy that all residents of San Vicente are invited to attend HOA meetings – but ONLY Association members are allowed to address the Board and to speak in public at the HOA meetings. Moved by Bob Mann and seconded by Lilith Imbrogno, Approved.

Open Discussion – Bob asked for any comments and/or from members about the upcoming Transition.  He asked the members to be brief and original.  Members shared concerns about:

  1. Timing of new Lease – legal opinion and timing
  2. Machines in the Clubhouse gym – in need of repairs, dangerous, whose responsibility
  3. Timing of subletting home when you live in the park – 1 year?
  4. Should we write to St Vincent’s about upcoming Park expenses/capital improvements to find out what will be passed on to the residents
  5. Many concerns about the Form that Sister Margaret mentioned at the “Meet and Greet” meeting – how much is your annual income?  When and why do we have to sign?  What is the result of signing for the residents?
  6. Would someone like to take over preparing “The Voice”?  Jeff Oien from Village Properties Real Estate has agreed to continue to finance the printing of the Voice. Volunteers are requested to help with the continuation and preparation of the Voice.

Much discussion about the questions that have been submitted to Stuart by residents and forwarded to Sister Margaret and not been specifically answered. It was moved by Ellen and seconded by Don that the Board send a letter to Sister Margaret containing the questions that Stuart has submitted and formally request answers.  There is to be no new questions. Motion passed.

Reminders – New leases will be sent Certified Mail. You will have to sign to receive. That signature does NOT mean you accept the new Lease agreement. The Association wishes residents to not sign any paperwork that goes back to St. Vincent’s until the association has proper legal advice.

Please NO SPEEDING! in our park

Mark thanked everyone on the transition committee for their work. The transition committee officially folded and encourages everyone to submit any questions before April 24th. No questions will be considered at the meeting other than the ones already submitted. It was suggested that if you have friends in Rancho ask them how they feel about their management as we will have the same. June 1st is the date the Sisters of Charity take over our lease.

Old/New Business. HOA membership is very important as greater member numbers make our positions stronger when dealing with management and the Sisters of Charity. Your HOA strongly recommends you submit your questions by April 24th in anticipation of the Meet and Greet meeting on April 27th at the Clubhouse. Gary Champ suggested to send a list of our needed park repairs to J and H Management team as well as the Sisters of Charity.

Hal Mishkin donated an elliptical treadmill machine which is now in need of repair with a cost of $300-350.00. He is requesting HOA pay for the repair as it is a good overall machine. Mimosas will be served at 11:00 and brunch will begin at 11:30. The menu is scrambled eggs, bacon, sausage, potatoes, cinnamon rolls and mimosas. Check the Voice for details.

GSMOL/Scamper Report: Ellen Duke encouraged everyone to join GSMOL as they represent mobile home owners in Sacramento and share information about pass throughs. She says we currently have 41 members in our park. If 15 members get together and vote we could have our own chapter here in our park.

Old Business: Frustrated residents are becoming increasingly concerned about the condition of our park. Residents complained about many problems including condition of the tennis courts, trees, driveways, streets, swimming pool deck and weeds. Many have reported the problems to management but have not had these issues fixed. The Board, once again, encouraged all residents to put their complaints in writing and give copies to the management and the Board. HOA membership is very important as greater member numbers make our positions stronger when dealing with management and The Sisters of Charity.

New Business: The HOA Board of Directors formed a Transition Committee made up of Board members and residents to meet and discuss our park’s pressing issues and report back to the HOA Board. The members are Mark Allen, Max Lynn, Derek Hanley, Don Webb, Ellen Duke and Cheryl Mrachek. The first meeting of this committee was Feb. 14. Three main points were discussed: how to increase HOA membership for strength in numbers, contact the Daughters of Charity and decide if an attorney to advise the residents was appropriate at this time. It was decided at the meeting that visits to non-members to encourage them to join the HOA was a good idea. Also, Mark Allen authored a letter to the Daughters of Charity to advise them of our organization. And, it was decided that an attorney could be hired after we have more information on the litigation that is occurring now between Parker Rice Corporation and The Daughters of Charity. A response letter was received from The Daughters of Charity thanking the committee for its interest and advising they would be in contact with the committee after litigation is settled with our current management.

Board member, Ellen Duke, said she feels the residents have an issue because the current management is taking our rent money each month but not providing satisfaction on maintenance problems. She encouraged everyone to put their complaints in writing.

Several residents would like more input as to what HOA does before they join and pay their $15.00 for membership. Board member, Ronnie Sumter, suggested a copy of the two letters and a copy of the minutes of this meeting be copied off and put in everyone’s mail tube. Another suggestion was to put the letters on the HOA website as the minutes of the meeting are always posted there. These suggestions will be taken under advisement by the Board and all information will be reviewed and approved.

The next Board Meeting will be Thursday, April 13, 2017

Board Members Present: Mark Allen, Tony Jimenez, Ellen Duke, Lilith Imbrogno

Board Members Absent: Jack Jackson, Cheryl Mrachek, Don Webb

Guests: Mary Jo Christensen, Angela Stephens, Betty Ortega, Doris Jimenez, Mollie Mann, George and Joanne Meers, Tony and Brenda Spinella, Derek Handley.

Bob Mann, president, called the meeting to order at 7:00 p.m. The October 13th Board Association Minutes were read and approved.

Treasurer’s Report: Paul Ortega reported that the checking account balance was $2,550.84, there were bank fees of $ 2.50, and the current balance is $ 2,548.34. In addition, legal defense fund balance is $ 20,903.99, plus DPG fund of $1,447.00, plus $2.00 interest, totaling $20,906.65. .

Social Committee Report: Mollie Mann reported that Christmas Dinner at $12 each is filling up fast. The Social Committee voted to up the price of the HOA Chili dinner to $10. There was concern this would impact attendance at the important HOA meeting. For this reason (since it is an official HOA meeting), the Board decided to contribute to the cost of the dinner up to $250, in order to keep the dinner cost at $5 each. Ellen made the motion: In order to keep the price of the Annual HOA Dinner down to $5, the HOA will provide the Social Committee up to $250. The motion was seconded and passed unanimously.

There was concern expressed that the Social Committee checkbook balance, at close to $4,000, was unnecessarily high and should be brought down a bit in lieu of raising prices for resident dinners. Currently, the Social Committee is raising prices in order to break even. The Social Committee is concerned that the new management may not continue the current donation. It was indicated by current management that the new management has made this commitment, but this will be checked again. It is also noted that December is the Social committee’s heaviest month for expenditures. Including entertainment at the Christmas dinner and the Christmas luncheon and gifts for our fabulous maintenance crew.

Under-Age Residents/Renters: There may be two units in our park with underage residents. One is a rental. There is concern that this might impact our senior park status. Bob will follow-up again. The board may write a letter of concern to management if no action is taken.

New Exercise Equipment: There is interest in getting newer exercise equipment. Liability issues were discussed. Bob will review this with current management.

Implications of Deferred Maintenance on Future Pass-Throughs to Homeowners:

The issue of deferred maintenance that might be reclassified as capital pass-throughs was brought up as a concern. The water system is aging and may require some replacement/repair. Concern was expressed that we do not have a good enough understanding of the pass-through regulations and should learn more to better represent the homeowners during the important transition. This discussion was tabled.

It was noted that the pool deck needs repair/maintenance.

The next Board meeting is Thursday, December 8th, 2016, at 7 P.M. in the Clubhouse.

The meeting was adjourned at 8:00 pm.
